SECTION 1 — PRIVACY POLICY

1.1 What We Collect

MY GUARDIAN AGENT collects only the data necessary to operate its accountability features. All data is stored locally on your device unless explicitly stated otherwise.

Precise Location (background): Used to detect when you enter or exit configured red and green zones. Location data is processed entirely on-device and is never uploaded to any server or shared with any third party.
SMS access: Used solely to send accountability messages to phone numbers you personally configure. The app does not read, store, or transmit your existing SMS messages.
Sobriety & health data: Sobriety start date, daily baselines (weight, custom metrics), journal entries, and zone history are stored locally on your device. This data never leaves your device.
AI chat messages: When you use the AI Agent feature, your messages are sent to Google's Gemini API to generate responses. This is the only data transmitted to an external server. See Section 1.3 for details.
Microphone (optional): Used only if you choose to record custom audio alerts for zone protocols. Recordings are stored locally and never transmitted.
Camera (optional): Used for the mirror accountability protocol feature. No images are stored or transmitted.
Activity recognition: Used to count steps during Walk Tracker sessions. Processed on-device only.

1.2 What We Do NOT Collect

No account, email address, or personal identity information is required or collected.
No advertising identifiers or tracking SDKs are used.
No crash reporting or analytics data is sent to external servers.
No data is sold, rented, or shared with third-party marketers.
No cloud sync or server-side storage of any personal data.

1.3 Third-Party Services

The only third-party service used by MY GUARDIAN AGENT is the Google Gemini API, which powers the AI Agent chat feature. When you send a message in the AI Agent screen, that message is transmitted to Google's servers to generate a response. This is subject to Google's Privacy Policy and Google AI Terms of Service. Do not share sensitive personal, medical, or financial information in the AI chat.

1.4 Data Retention & Deletion

All locally stored data is retained on your device until you uninstall the app or manually clear the app's data in Android Settings. Uninstalling permanently deletes all locally stored data. We have no ability to recover this data on your behalf.

1.5 Children's Privacy

MY GUARDIAN AGENT is intended for adults aged 18 and older. We do not knowingly collect any information from users under 18.

1.6 Changes to This Policy

We may update this Privacy Policy from time to time. The effective date at the top will reflect any updates. Continued use constitutes acceptance.

SECTION 2 — TERMS OF USE

2.1 Acceptance

By installing or using MY GUARDIAN AGENT, you agree to these Terms of Use. If you do not agree, do not use the app.

2.2 Intended Use

MY GUARDIAN AGENT is a personal accountability tool for adults who wish to avoid locations associated with substance use or other behaviors they are working to change.

2.3 Not a Medical Device

This application is not a medical device and does not provide medical advice, diagnosis, or treatment. It is not a replacement for licensed addiction treatment, counseling, therapy, or any other clinical service. Always consult qualified healthcare professionals.

2.4 Emergency Situations

MY GUARDIAN AGENT is not an emergency response service. In any emergency, call 911. For mental health crises, call or text 988. For substance use support, call 1-800-662-4357 (SAMHSA, free, confidential, 24/7).

2.5 User Responsibilities

You are responsible for configuring the app accurately, including zone locations and accountability contacts.
You must obtain consent from any accountability contact before adding their phone number.
Do not use this app in any way that violates applicable laws or the rights of others.
You are solely responsible for your own recovery decisions and outcomes.

2.6 Limitation of Liability

To the maximum extent permitted by law, the developer of MY GUARDIAN AGENT shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of this application. The app is provided "as is" without warranty of any kind.

2.7 GPS & Technology Limitations

Geofencing accuracy depends on device GPS hardware and signal availability. The app cannot guarantee detection of every zone entry or exit. Do not rely on this app as your sole safeguard in high-risk situations.

2.8 Governing Law

These Terms are governed by the laws of the United States and the state of the developer's residence.
